Started in internet radio in 1999 as an outgrowth of my working at 'VUD.

Hard to imagine that anybody who does podcasting or internet radio doesn't know these things.

Too bad I'm so looked down on here. Had anybody bothered to ask, I could have saved you a lot of trouble and told you exactly how to do it from step one.

It ain't exactly rocket science.

I joined ASCAP about a year ago figuring that if I ever finish my CD going through them will help me get royalties and whatnot easier… but this is having me reconsider my membership.

As a small-time, self-produced, indy sort of musician, I gotta say that I really hate "The Man" in the music business. What are some alternatives to membership in BMI and/or ASCAP?

It seems that the music, television and movie industries seem to be really behind the times and are purposely trying to do so. I think that they know that the general public would prefer to get their media legally over the internet but they want to hold onto their old business models and try to tell their consumers what to do. This may work for a while, but I think the public will gravitate to smaller companies that has embraced the new technology.

How about creating your own bumper music in Garageband? You cannot copyright chord progressions and you could still have some music that would sound professional and be at least somewhat original.
I'm with Steve on bureaucrats, for what it's worth. We need the oxygen they waste for other things.

Yeah, Sound Exchange handles the other stuff, but there's still no system for making podcasting music legal since they consider it actual duplication of music as opposed to a live stream where the music is not captured by the end user (interactive use vs. non interactive use if I remember correctly).

Giant pain in the ass when you're talking bumper music on a podcast or music in the background…especially when we'd pay the damn fee if such a structure existed within which to do so, but nooooooooooo, they don't want the free promotion.

I´m a former employee of ASCAP and I´m guessing that the reason why they don´t license podcasts is because they only license the public performance rights, not the mechanical rights or the master recording right which seems to be the case here.

All I can say is the US does not have as much to fear from the terrorists as it has to fear from "Bean Counters." You know what a bean counter is? That's someone who keeps the rules once they forgot the reason for keeping the rules.

The past 3 years I've had enough of lawyers and bean counters. I'm looking for a little hut on the beach on a caribbean island.

My only hope is John 16:33 “"I have told you these things, so that in me you may have peace. In this world you will have trouble. But take heart! I have overcome the world."

Well if you don't call it a podcast but instead a broadcast then you could stream it through live365 pay the monthly fee 25-100 bucks or so and your covered for ASCAP, BMI and that sort of stuff. However there is no ability to download….grrr and that is not really what you want. Well no legal way to download.

But the other stuff is so strange and really out there. Has everyone become so finger pointing about this or that that anything we do that might be public has to be in triplicate on someones desk before we do it?

Pretty soon we will have papers super glued to our front doors telling us to write in detail about our day just in case there is ever a need for someone else not to be responsible for something they might do because of something they think someone else has done.

I am very glad God does not work like that I already have enough of my own junk.
